A process server will distribute legal papers (serve) to any person needed for a lawsuit.
If somebody won’t pay child support, goes into personal bankruptcy by not paying bills, breaks a rental contract illegally, or is otherwise required to go to court, they have to be served an order informing them of impending charges and also the date of proceedings. Notifying the defendant is the responsibility of the individual (or organization) filing the notice. Even in this technological time, a call or e-mail will not be adequate; the law states that the defendant will have to be advised face-to-face of the impending action against them. However, not just anyone can serve the legal papers. That’s where the process server comes in.
If the Process Server has been unable to deliver the notice to the individual, they may also effect service through ‘Substituted Service’. Which means, they alternatively deliver the paperwork through insertion in the letterbox or in another way that it will come to the attention of any individual entering the building, for example, stick to the entry door.
